Find the framework that fits the responsibility you hold.

California’s Probate Code includes distinct rules for trusts and decedents’ estates. The trust investment framework appears in Article 2.5 of the trustee duties chapter; estate management has its own provisions. A section relevant to one role should not automatically be applied to another.

Practical documentation steps

These are suggested organizing practices, not a complete statement of legal requirements.

  1. Identify the engagement type and the person’s actual authority.
  2. Keep the governing document and relevant court orders together.
  3. Ask counsel which statutes, court rules, and local procedures apply.

A question for your professional

Which parts of the Probate Code govern this particular engagement?

Know the limits

Applicability depends on your role, the governing documents, the facts, and current law. Trust examples should not automatically be applied to estates or other engagements. Federal tax, other-state law, and court-specific issues may require separate research and advice.
